Soju Christmas Tree Guessing Competition Terms & Conditions

1. Introduction

 

1.1. Information on how to enter and prizes available form part of these Terms and Conditions.

 

1.2. Entry into this Competition deems acceptance of these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

 

2. Details of Promoter

 

2.1. This competition is run by SOJU KOREAN RESTAURANT ABN 87 630 315 847 referred to throughout as “Promoter” or “Soju”.

 

3. Who can enter

 

3.1. Entry is open to all Australian residents, who reside in Australia (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the competition and their related companies are ineligible to enter.

 

3.2. The competition is only open to individual natural persons.

 

4. How to enter

 

4.1. The Competition comprises a game of skill, facilitated on the Soju Wetherill Park Facebook Page (https://www.facebook.com/sojuwetherillpark), and the@soju_wp Instagram Page (https://www.instagram.com/soju_wp/) during the competition period from Saturday 14th November 2020 at 5:00pm AEDT and closes on Friday 20th November 2020 at 11:59pm AEDT (‘Competition Period). All entries must be received by Friday 20th November 2020 at 11:59pm AEDT. Entries received after this time are ineligible.

 

4.2. To enter, Entrants must submit a comment under any of the competition posts outlined above with answers to the following:

 

1) Guess the number of soju bottles used to create our Christmas tree on display at Soju Wetherill Park. The closest guess without going over the correct numb wins. If more than one correct guess is submitted, the user who guessed the correct number first, as judged by the comment's time stamp, will be deemed the winner.

 

The winning entry will receive a $50 credit against their name to be used at Soju Wetherill Park before 31st December 2020. The credit will be redeemable at the time of purchase within the restaurant, with the $50 deducted from their bill. The gift is non-transferable and cannot be redeemed for cash. If the total bill comes to less than $50, the remaining monies will be forfiet. 

 

Decisions of the Competition and its panel of judges are final and will be binding on each person who enters the competition and no correspondence will be entered into.

 

4.3. Entrants may enter the Competition as many times as they like within the Competition Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Competition database. The Competition is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Competition Period.

 

4.4. No purchase is necessary to enter. Purchasing products will not help your chances of winning.

 

4.5. By entering the competition, the winner consents to giving permission for their submission to be published by Soju on Social Media for purposes of announcing the competition winners.

 

5. Prizes

 

5.1. There will be one (1) prize in total over the Competition Period. One (1) winner will be selected from the online entries on the Competition Post for the Competition Period.

 

5.2. The total Prize Pool is valued at $50. The winner will receive one (1) Prize in total, and will be contacted via social media. If the winner does not reply within 24hr. A new winner will be selected based on the competition criteria.

 

No responsibility is accepted for any variation in the value of the prizes.

 

6. Competition Adjudication

 

6.1. The Promoter will make all reasonable attempts to identify and contact the winner.

 

6.2. The competition adjudication will take place Saturday 21st November 2020 between 12pm-1pm AEDT by Studio Hudson, 37 Nancarrow Ave, Ryde.

 

6.3. Following the conclusion of the Contest Period, all eligible Entries received during the Contest Period will be shortlisted by a panel of judges chosen by the Contest Sponsor, at the offices of the Contest Sponsor. One (1) winner will be selected by a panel of judges based on the criteria above.

 

6.4. The prize winners will be announced on Facebook and Instagram on Saturday 21st November 2020 via a public post, and followed up via Direct Message.

 

6.5. Three attempts will be made to contact the prize winner by the Facebook wall and private messenger. If no contact is made with the prize winner after three attempts, over a period of 24hrs, then at Soju's sole discretion, that prize winner’s entry will be deemed invalid and null and void and the second eligible entry of the promotion period as decided by the adjudication team will replace the former prize winner as a new prize winner of the same category of prize.

 

6.6. The Promoter will send confirmation of the Prize, including instructions on delivery of the Prize, to the winner (by email or private message) within five days of winner confirmation. The winner of a Prize must accept the Prize in accordance with the Promoter's instructions or the winner will be deemed to have forfeited his or her right to the Prize.

 

7. Further terms and conditions of entry

 

7.1. By entering this Competition you authorise that they are your own and that you are permitted to distribute your details.

 

7.2. By entering this Competition you authorise the Promoter to use content from your valid competition entry on the Soju Wetherill Park Facebook Page (https://www.facebook.com/sojuwetherillpark), and the@soju_wp Instagram Page (https://www.instagram.com/soju_wp/).

 

7.3. The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.

 

7.4. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.

 

7.5. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

 

7.6. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c)any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.

 

7.7. If for any reason the Competition is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Competition, subject to any directions from a regulatory authority.

 

7.8. The information entrants provide will be used by the Promoter for the purpose of conducting this Competition. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Competition.

 

7.9. This Competition is not sponsored, endorsed, administered by or associated with Facebook or Instagram. You understand that you are providing your information to GoDaddy AU and not to Facebook.

 

7.10. In order to conduct this Competition, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Competition is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Soju database. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes asset out in the Soju Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. 

 

7.11. The collection, use and disclosure of personal information in connection with the Competition is governed by the Privacy Act 1988 (Cth). By entering the Competition, Entrants agree and consent to the Promoter: using and disclosing the Entrant’s personal information for the purposes of conducting the Competition, redeeming the Prizes and any other matter connected to or incidental to the Competition; using the Entrant’s personal information or user generated content for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including mail and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition and for any other purpose at the Promoter’s sole discretion.
